Last week M·CAM, Inc. President, David Pratt and the M·CAM Analyst team were featured in a front page story of the New York Times titled “The Patent, Used as a Sword”. This week, M·CAM, Inc. and Dr. David Martin make an appearance in yet another article comparing today’s patent system to an arsenal of dangerous weapons; coincidence? We don’t think so.

Dr. David Martin teamed up with Juliane von Reppert-Bismark, MLEX Magazine Managing Editor, in the latest issue of the MLEX magazine titled The Patent Armory. In Dr. Martin’s report titled “Paper Weight”, he addresses the out-of-control patent system as it continues to overload the U.S. court system and federal agencies with complex decisions on the digital economy, which if not handled properly, could trigger a horrific backlash. Dr. David Martin Featured in The Wealth of the Commons: A World Beyond Market and State

Dr. David Martin’s essay entitled “Emancipating Innovation Enclosures: The Global Innovation Commons” was recently published in the the English version of an anthology of essays, The Wealth of the Commons: A World Beyond Market and State, by David Bollier. Dr. Martin’s essay discusses the various ways in which patents merely represent social contracts that manage market scarcity and thereby profit when used as litigation weapons. Mr. Bollier and Silke Helfrich, a German colleague, had been working on the translation of the book for nearly a year and a half and it’s release comes with great anticipation and excitement.

“Never before have so many different international voices about the commons been brought together in one volume. The Wealth of the Commons consists of 73 essays by a diverse roster of international activists, academics and project leaders. It consists of descriptions of specific commons innovations, essays on the theory and economics of commons, accounts of different types of enclosures around the world, and much else.”

We are between an old world that no longer works and a new one which is struggling to be born. Surrounded by centralized hierarchies on the one hand and predatory markets on the other, people around the globe are searching for alternatives. The Wealth of the Commons explains how millions of commoners have organized to defend their forests and fisheries, reinvent local food systems, organize productive online communities, reclaim public spaces, improve environmental stewardship and re-imagine the very meaning of “progress” and governance. In short: how they’ve built their commons. The hope is that the book will help pave the pathway for more robust discussions in political policy and activist circles which are beyond market and state as the only feasible solutions.

M·CAM Releases 2012 Heritable Innovation Trust Document

September 26, 2012 – East New Britian, Paupa New Guinea; Charlottesville, Virginia — M·CAM Releases 2012 Heritable Innovation Trust Document. Similar to the 2011 document, the 2012 document is organized in an encyclopedia format, to compile all of the information collected over the past three years into one integrated document.

The 2012 document includes a look into a new community, Navunaram as well as eight new trust items. This year’s efforts could not have been completed with out the contributions of our interns, Julia Craig, Hector Feliciano-Ayala and Michael Venable as well as our Heritable Innovation Trust Coordinator, Katie Martin and our on-site partners Theresa Arek, Sharmayne Ryan, and Ian Sexton.

M·CAM Inc. Participates in United Way’s 2012 Day of Caring

On September 19, M·CAM Inc, went out into the community to “spread the well-being” for a second year in a row. Along with a company wide goal of individual community engagement by each team member, M·CAM Inc. decided to participate in a group community engagement project through United Way’s Day of Caring. The group helped the Broadus Wood Elementary School in Earlysville, Virginia, clean an old storage container & tidy up the gardens in front of the school.

The Day of Caring was established in 1992 by the United Way-Thomas Jefferson Area to promote the spirit and value of volunteerism, increase the awareness of local human service agencies and schools, and demonstrate what people working together for the community’s good can accomplish. In 1999, the Day of Caring was renamed the United Way Laurence E. Richardson Day of Caring in honor of Larry Richardson, a long-time volunteer of the United Way and the community, and past president of the Charlottesville Broadcasting Company.

‘If this were my patent, could I defend it?’ was the question jury foreman, Velvin Hogan asked himself when considering the Apple Samsung patent infringement suit. On August 24th, 2012 a nine person jury reached the verdict which awarded Apple slightly over $1 billion in damages. This is a grievous miscarriage of justice in which Velvin played an active role. Velvin does not understand that novelty and obviousness are what determine patent validity. His public opining reinforces the widespread ignorance of the broken patent system and the myth of Apple’s innovation.

Charlottesville, VA- August 6, 2012: Dr. David Martin will be speaking at the TEDx ArdenArcade event on August 18 in Sacramento, California. This TEDx event will be bring together some of the world’s most creative minds and forward thinking to share their personal stories, insights, and passions.

Dr. Martin, curator of the Global Innovation Commons and Founding Chairman of M∙CAM will paint a picture of a future in which we honor all of the Commons and the Commoners and demonstrate how it’s already here.

Chairman Quoted In Financial Times Regarding Kodak

CHARLOTTESVILLE, VA- Dr. David Martin discussed the Kodak patent auction with Richard Waters.

“Many of the digital imaging patents up for auction were filed later than those of other companies, reducing their value, said David Martin, chairman of IP research firm M-Cam. “Kodak was quite late to the game in digital image management and capture,” he said.”

In May of 1993, Martin Kelly Jones filed his first patents on vehicle tracking systems and established the early priority dates of many of his modern-day patents. Since that time, Melvino Technologies Limited (MTL), the company that apparently owns Martin Kelly Jones’ patents, and ArrivalStar S.A., a company that licenses those patents , have deployed a classic non-operating entity business model.

“Other critics say that even if Apple did it all best, it wasn’t even the first to get a patent on these designs. David Martin, the chairman of M-Cam, a company that evaluates the value of patents, says the difference between the emotional response that says these technologies look alike and the actual construction of the patent law are two different things.

M·CAM, Inc. releases Patently Obvious® on Maxim Integrated Products, Inc.

In the second half of 2011, the semiconductor company Maxim Integrated Products, Inc. (MIP) sent letters to multiple companies asserting infringement on four of MIP’s mobile application patents. In 2012, MIP started filing lawsuits against many of those companies. Meanwhile, other proactive entities are filing invalidation suits against MIP. This tangled mess has quickly become a Gordian knot in need of cutting, and the corporations attempting to invalidate MIP’s patents have started doing so.

CHARLOTTESVILLE, VA – July 2nd, 2012 – M·CAM, Inc. releases Patently Obvious® on Intellectual Property Analysis of Personal Voice Freedom, LLC v. YMAX Corporation et. al.

On November 9th 2010, Personal Voice Freedom (PVF) filed an infringment suit against YMAX Corp. as well as its subsidiaries magicJack LP and TigerJet Network Inc. In an effort to fight off the case, magicJack filed for a reexamination of the asserted patent, US 7,336,654 with the United States Patent and Trademark Office (USPTO) in November of 2011. The patent was reissued with amended claims and magicJack has subsequently appeared to enter a settlement agreement with PVF.
