First meeting of Advisory Board on Air Pollution and Heat Efficiency

Ulaanbaatar – 11 November, 2010 –– M–ICP organized the first meeting of Advisory Board on Air Pollution and Heat Efficiency today in XacBank conference room at Central Tower today. 15 Mongolian experts representing different agencies, including research institutes, companies, UB city Air quality department and NGOs attended this meeting. Ms. D.Nergui. M–ICP CEO opened this meeting and made a brief presentation on M–ICP business model. The video presentation on E–Z launch prepared by Mr. J. Soyol–Erdene, Journalist of Mongolian National Broadcasting was a part of kick–off for this meeting. Participants exchanged their experiences of their attempts has been made to reduction of air pollution and increasing heat efficiency and views on possible ways to resolve these challenges that Mongolia has been facing for decades with no proper practical solutions and results to date. During this meeting Mr. O. Badral, NVC/MIH Group expressed his company willingness to cooperate with and invest in innovative business initiatives toward sustainable development. The second meeting of the Advisory Board will be held in December when E–Z delegation will come to Mongolia.

Mr. D. Jargalsaikhan, a graduate of Lomonosov Moscow State University and Denver University, USA is considered as one of top economists and finance specialists of Mongolia and worked in senior positions of Capital Bank, FIFTA, MIAT Tour, Juulchin, Mongolian Oil Company and International Student’s Association in Prague. He is a founder of Ulaanbaatar Rotary club, the first Rotary club in Mongolia and served in the Board of number of NGO’s such as Open Society Forum, MONPECC, Ulaanbaatar Rotary. He is a President of Mongolians for in–justice tax and smart expenditure NGO. He is advising companies, banks and other financial institutions on management, strategic planning and competitive capacity in particular.

M-ICP CEO visit to new laboratory

Ulaanbaatar – 4 November, 2010 –– M–ICP team led by Ms. D. Nergui visited the new laboratory which to be used mainly for heat efficiency purpose today. The laboratory has been established recently with ADB support. Team met with Dr. S. Lodoisamba, Head of Information and technology faculty of the Mongolian National University who has been assigned to lead the research in this laboratory. Dr. S. Lodoisamba is a nuclear researcher by background.

Meeting on Innovation sub-program of Ulaanbaatar city

Ms. D. Nergui meets with Ms. B. Gantsetseg, Specialist of Urban Development and Policy Department today at her request. The main topic of discussion was on how Ulaanbaatar city can promote innovation and high tech industry to achieve higher economic growth and increase the living standards of the capital city population.

Possible business cooperation with ASS

M–ICP CEO meets with Mr. D. Budkhand, CEO and Ms. Norjmaa, Finance Manager of Altan Suljee Systemus LLC (ASS) today at their request. The ASS is specialized in crop and food production industry and is planning to expand their production by using modern technologies. M–ICP and the ASS agreed in principle to cooperate in number of areas, including setting–up manufacturing facility to produce more value–added food stuff, food storage, and biofuel production. Heads of two companies and a researcher who was looking for a partner to do some research in the area of biofuel will meet soon to discuss about the possibility of collaboration.

Philips Electronics North America Corporation et al. On February 3, 2009, Masimo initiated a lawsuit against Philips Electronics, alleging that some of Philips’ products, namely their FAST pulse oximetry technology and certain Philips patient monitors, infringed on patents held by Masimo.

Meeting in the Air Quality Department of the Capital City

Ulaanbaatar – 3 November, 2010 –– M–ICP CEO meets with Mr. Seded Chijil Khatagin, Air Quality Department of the Capital City today. The main themes of discussion were cooperation on EZ implementation and exchange of air pollution, heat efficiency related information. Ms. D. Nergui, CEO invited Mr. Seded to join the M–ICP Advisory group/Committee on air pollution and heat efficiency. CEO will invite other Mongolia’s top experts, researchers and engineers working on relevant areas to join this group. Mr. B. Bat–Erdene, Nanotech researcher of NUM/M–ICP Technology expert and Mr. L. Enkhbat, M–ICP also attended this meeting.

Note: In addition to its official administrative structure, the M–ICP will have as originally planned number of Advisory groups/Committees aimed to provide financing policy, business Innovation and technology advices to the government, companies and other relevant institutions through M–ICP management. As air pollution and heat efficiency is one of pressing challenges of Mongolia, Ulaanbaatar city in particular, the advisory group on air pollution and heat efficiency will become M–ICP first Advisory group.

Meetings at the Parliament

Ms. D. Nergui had two meetings today with Parliament members – first with Mr. Ts. Davaasuren, Chairman of Budget Standing Committee of the Parliament and the second is with Mr. D. Zorigt, Parliament member. Main areas of discussion were (¡) importance of revisiting the Investment agreement of Oyu Tolgoi as Mongolia – Mongolian people who supposed to be an owner of its wealth, including underground mineral resources by the Constitution of Mongolia are in extraordinary disadvantaged position which is evident and is unethical and unacceptable and (¡¡) the importance of introduction of Offset mechanism which can help Mongolia to increase its technology competence and capacity and also can help the country to expand its manufacturing and agriculture sector production and export potential through this mechanism, including countertrade.

On October 5, 2010, NuVasive, Inc. initiated a patent infringement lawsuit against Globus Medical, Inc. over Globus Medical’s LLIF lateral fusion offerings. In fact, this is just the most current in a string of lawsuits NuVasive has levied against competitors such as Orthofix International and a counterclaim against Medtronic. Ulaanbaatar – 27 October, 2010–– M–ICP Policy recommendation which includes the necessity and importance of introduction of Trade –credit offset (TCO), technology and vendor qualification, a need for increased support for innovation, science and technology development and creation of necessary infrastructure for TCO and the use of intangible assets for loan collateral has been delivered to Mr. Ts. Bayarsaikhan, Chairman of Economic Policy Standing Committee of the Parliament today.

Trade–Credit Offsets: Experience of most countries using TCO showed that it contributes significantly to industry and infrastructure development and acceleration of economic growth, and increase country’s competitiveness, in particular it helps countries to increase its technology competence, to develop high value–added manufactured goods and create more jobs. The use of TCO can help our country to decrease the risk of Dutch decease by providing adequate support to development of manufacturing and agriculture sectors. The mechanism can be used for large investment projects such as Oyu Tolgoi, Tavan Tolgoi, building of power plants, copper smelters etc.

Technology and Vendor Qualification: The use of this service reduces the risk of importing low quality technologies from unreliable, dishonest and unethical suppliers and provides companies and the government to negotiate well with their negotiating parties based on high quality expert service on technology and vendor. This service is also important for above mentioned large projects.

22 October, 2010 –– Ms. D. Nergui was interviewed by Ms. A. Munkhnast, and Ms. B. Oyungerel, Mongolian National Chamber of Commerce and Industry today. The e–newsletter “IP Newsletter” will publish this interview in its upcoming edition on Innovation.

The MNCCI was founded as the “Chamber of Commerce” on 2 July 1960. Until 1990, in coordination with socialist system, the activities of the Chamber have organized the limited promotion of trade and industry as a quasi–governmental agency. The transition to a market economy gave the private sector effectual association within the Chamber. In the course of 45 years of history, the Chamber has conducted activities within an administration scope and acted independently for the last 15 years.

The first meeting of the Chamber affiliates was held in 1961 and 29 organizations were admitted as active members. Since the adoption of the “Law of the Chamber of Commerce and Industry” (1995), the Chamber’s activities have expanded both domestically and abroad. At present, the Chamber is the main representative body of the Mongolian business community and engages businesses, enterprises, and trade organizations in a wide range of activities and services in protecting common interests. CHARLOTTESVILLE, VA – October 21, 2010 –– M·CAM, Inc. released its Patently Obvious™ report today on US Pat. No. 5,251,294, which Webvention LLC purchased from Intellectual Ventures. The ‘294 patent describes a mouseover expansion feature that is common to many websites. Webvention, a non–operating entity based in Eastern Texas, claims to have licensed the ‘294 patent to 144 companies since its purchase from Intellectual Ventures. In addition, the company has filed two lawsuits since July accusing more than 35 companies of patent infringement. However, there are a handful of companies that will not surrender to the threat of antagonistic litigation. Novartis, TriMas, Instinet and Tenneco Automotive Operating Company have all filed counter suits asking that the patent be invalidated.

At the dawn of its release, Microsoft has filed a lawsuit against Motorola, who has yet to commit to the Windows Phone 7 platform. Microsoft claims that the handset OEM’s Android phones infringe nine of its patents.

CHARLOTTESVILLE, VA – October 13, 2010 –– M·CAM, Inc. released its Patently Obvious™ report today on the patent holdings of Mirror Worlds Technologies, Inc. highlighted in Mirror Worlds LLC v. Apple Inc., 08cv88, U.S. District Court for the Eastern District of Texas. Apple has historically been quite successful at predicting consumer preferences and has capitalized on their foresight to drive consumer demand. Their enviable position of success has opened the door to both legitimate and opportunistic lawsuits concerning their intellectual property. On March 14, 2008, Mirror Worlds, LLC sued Apple, claiming that CoverFlow infringed on four of its patents. More than two years later on October 1, 2010, Apple was found to have infringed on Mirror Worlds’ patents and was ordered to pay up to $625.5 million to the plaintiff ($208.5 million for each patent infringed). Ironically, during the course of the lawsuit proceedings, Apple was granted a patent on its CoverFlow interface. Apple is currently appealing the verdict.
