Dr. David Martin to Present at the Women in Housing and Finance Brown Bag Lunch (11/14/2012)

Date:  Thu, 2012-11-08

CHARLOTTESVILLE, VA & Washington D.C. – On Wednesday, November 14, 2012, M·CAM Chairman David Martin will be presenting at the Women in Housing and Finance Brown Bag Lunch event. Other speakers include James Loder, SVP & Chief Underwriting Officer Complex Situational Risk Insurance (CSI), and Brian O’Hara, former CEO of XL Capital Ltd.The topic for the event is: “Attracting Tier 1 Capital to Banks by Bringing Liquidity to Innovation Assets.”

Topic Background: America’s innovation assets — patents, trademarks, copyrights, permits, licenses, contract rights, etc. — are completely encumbered within senior secured bank loans and yet none of that asset value is counted by regulators when they look at bank capital reserves.

The mispricing of risk around these innovation assets has created a market opportunity for highly rated counterparties to provide liquidity to banks. At the event, we will discuss such a liquidity bridging mechanism. As evidenced by transactions like the sale of Nortel’s patents for $4.5 billion out of bankruptcy and Google’s acquisition of Motorola Mobility for $12.5 billion “primarily for their patents”, there is significant latent value for which banks, and their job creating corporate borrowers, are not benefiting.

Speaker Bios:

Dr. David E. Martin, Founder and Chairman of M·CAM Inc., the international leader in innovation finance, trade, and intangible asset finance. Dr. Martin is a Batten Fellow at the University of Virginia’s Darden Graduate School of Business Administration.

James Loder, SVP & Chief Underwriting Officer Complex Situational Risk Insurance (CSI), leads XL Group’s CSI team. He focuses on the creation of novel solutions for complex and unique non-traditional insurance risks and transactional and contingent liability exposures.

Dr. David Martin’s Interview on Bloomberg (10/24/2012)

Date:  Thu, 2012-10-25

On May 6, 2011, M·CAM published a Patently Obvious™ Report on the “Intellectual Property Analysis of Apple Inc.’s U.S. Patent No. 7,469,381” Link: http://bit.ly/RVUTe1. This report called into question the enforceablilty of Apple’s ‘381 patent naming the same patent that M·CAM had identified – – U.S. Patent No. 7,786,975 [‘975], among others, as potentially uncited prior art. As reported in yesterday’s New York Times (http://nyti.ms/QXnlv8) and elsewhere, the U.S. Patent and Trademark Office has decided in an initial ruling that this patent should never have been granted, confirming the ‘975 patent as limiting prior art. “Claims 1-5, 9-13, and 15-20 are rejected under 35 U.S.C. 102(b) as being anticipated” by the ‘975 patent.

Last night, Dr. David Martin appeared on Bloomberg with Bloomberg West’s Cory Johnson. Dr. Martin and Mr. Johnson discussed the patent decision and what can be expected to unfold next in this smartphone war. See the video here: http://bloom.bg/VpIVdD

What does this mean? Using M·CAM’s proprietary financial underwriting systems, M·CAM was able to identify the precise prior art which may have an adverse impact on the appeal of the $1.05 Billion judgement. More amazingly, M·CAM was able to identify this a full 1.5 years before the judgement came in!

What does this mean for YOU? M·CAM’s risk management and underwriting systems can be deployed to identify uncorrelated information and measure the material impact it will likely have on the value of your current and anticipated investments. On May 6, 2011, M·CAM published a Patently Obvious™ Report on the “Intellectual Property Analysis of Apple Inc.’s U.S. Patent No. 7,469,381” Link: http://bit.ly/RVUTe1. This report called into question the enforceablilty of Apple’s ‘381 patent and identified M·CAM’s lead challenge, U.S. Patent No. 7,786,975, among others, as potentially uncited prior art. As reported in today’s New York Times (http://nyti.ms/QXnlv8) and elsewhere, the U.S. The potential invalidation of patent ‘381 could have a significant effect on the billion dollar Apple/Samsung award as well as future litigation.

Date:  Tue, 2012-10-16

Last week M·CAM, Inc. President, David Pratt and the M·CAM Analyst team were featured in a front page story of the New York Times titled “The Patent, Used as a Sword”. This week, M·CAM, Inc. and Dr. David Martin make an appearance in yet another article comparing today’s patent system to an arsenal of dangerous weapons; coincidence? We don’t think so.

Dr. David Martin teamed up with Juliane von Reppert-Bismark, MLEX Magazine Managing Editor, in the latest issue of the MLEX magazine titled The Patent Armory. In Dr. Martin’s report titled “Paper Weight”, he addresses the out-of-control patent system as it continues to overload the U.S. court system and federal agencies with complex decisions on the digital economy, which if not handled properly, could trigger a horrific backlash. To read the full MLEX Magazine article, please visit HERE.

Dr. David Martin Featured in The Wealth of the Commons: A World Beyond Market and State

Date:  Wed, 2012-10-03

Dr. David Martin’s essay entitled “Emancipating Innovation Enclosures: The Global Innovation Commons” was recently published in the the English version of an anthology of essays, The Wealth of the Commons: A World Beyond Market and State, by David Bollier. Dr. Martin’s essay discusses the various ways in which patents merely represent social contracts that manage market scarcity and thereby profit when used as litigation weapons. Mr. Bollier and Silke Helfrich, a German colleague, had been working on the translation of the book for nearly a year and a half and it’s release comes with great anticipation and excitement.

“Never before have so many different international voices about the commons been brought together in one volume. The Wealth of the Commons consists of 73 essays by a diverse roster of international activists, academics and project leaders. It consists of descriptions of specific commons innovations, essays on the theory and economics of commons, accounts of different types of enclosures around the world, and much else.”

We are between an old world that no longer works and a new one which is struggling to be born. Surrounded by centralized hierarchies on the one hand and predatory markets on the other, people around the globe are searching for alternatives. The Wealth of the Commons explains how millions of commoners have organized to defend their forests and fisheries, reinvent local food systems, organize productive online communities, reclaim public spaces, improve environmental stewardship and re-imagine the very meaning of “progress” and governance. In short: how they’ve built their commons. The hope is that the book will help pave the pathway for more robust discussions in political policy and activist circles which are beyond market and state as the only feasible solutions.

M·CAM, Inc. releases Patently Obvious® on the Apple Samsung Verdict and the Jury Foreman

Date:  Thu, 2012-08-30

CHARLOTTESVILLE, VA August 30, 2012 – M·CAM, Inc. released its Patently Obvious® report today on the Apple Samsung Verdict and the Jury Foreman

‘If this were my patent, could I defend it?’ was the question jury foreman, Velvin Hogan asked himself when considering the Apple Samsung patent infringement suit. On August 24th, 2012 a nine person jury reached the verdict which awarded Apple slightly over $1 billion in damages. This is a grievous miscarriage of justice in which Velvin played an active role. Velvin does not understand that novelty and obviousness are what determine patent validity. His public opining reinforces the widespread ignorance of the broken patent system and the myth of Apple’s innovation.

M·CAM’s Patently Obvious® is a weekly report providing visibility into potentially unconsidered alternatives, including art in the public domain, to patent holdings across a variety of technology areas.

M·CAM, Inc. is a global, full-service intellectual property and rights (IP&R) and intangible asset financial services firm. We provide the technical and financial systems that allow public and private markets to use IP&R and IA for regulated transactions in banking, securities, insurance, and public innovation investment and technology procurement. From our pioneering work in creating the world’s first standards-based innovation collateralization financial products for banking and securities to our work in grassroots innovator enablement and patent quality assurance programs, M·CAM provides the mechanism to balance the interests of public and commercial sectors to support and build thriving economies.
